(1) According to clause (j) of section 3 of the Act, the performance level of the nominated member should be satisfactory.
(2) If the performance level of a member according to sub-rule (1) is not satisfactory, the Prime Minister will demand an explanation from such member to be submitted within seven days if there is any reason why he should not be removed from the position of a member.
(3) If an explanation is requested as per sub-rule (2), if he does not give an explanation within the prescribed period or if the explanation given is not reasonable, the Prime Minister may remove him from the position of a member.
